Welcome to MADE Baseball! These Terms of Service (“Terms”) govern the relationship between MADE Baseball, its clients, and its independent contractor coaches. By engaging in MADE Baseball’s services or coaching programs, you agree to abide by these Terms. Please read them carefully.
SECTION 1: TERMS FOR CLIENTS
1. Services Overview
MADE Baseball connects clients with independent baseball coaches for private lessons and small group training. Our goal is to provide a safe, professional, and enriching environment to help players develop their skills.
Key Service Details:
•MADE Baseball carefully selects coaches through a thorough vetting process, including interviews, experience verification, and comprehensive background checks conducted by Checkr, a trusted screening service.
•Coaches operate as independent contractors and are solely responsible for the execution of lessons, including safety and adherence to MADE Baseball’s standards.
•Lessons are performed at public parks or other agreed-upon locations.
By booking lessons with MADE Baseball, clients acknowledge that coaches are independent contractors and not employees of the Company. MADE Baseball acts solely as a platform to facilitate lessons, bookings, and payments.
2. Assumption of Risk and Liability Waiver
Baseball training involves inherent risks. By participating in any MADE Baseball program, clients agree to the following:
•Acknowledgment of Risk: Clients understand that activities involving baseball may cause injuries, including but not limited to being struck by balls or equipment, physical strain, or weather-related conditions.
•Assumption of Risk: Clients voluntarily assume all risks associated with participation in baseball lessons.
•Liability Waiver: Clients waive the right to hold MADE Baseball, its coaches, or its affiliates liable for any injuries, property damage, or losses sustained during lessons, including those caused by negligence.
3. Booking Process
Booking a lesson through MADE Baseball is simple:
1.Browse our coaches based on bios, availability, and location.
2.Fill out the required intake form, including your information, your player’s details, and acknowledgment of our Liability Waiver, Policies, Terms of Service, Privacy Policy, and Cancellation Policy.
3.Submit payment at the time of booking to confirm your session.
4.Your selected coach will contact you within 24 hours to confirm the lesson date, time, and location.
If you do not hear from your coach within 24 hours, please contact MADE Baseball at support@madebaseball.com.
4. Scheduling, Cancellations, and Refunds
Scheduling:
•All lessons must be booked at least 24 hours in advance.
•Clients may schedule lessons up to 90 days in advance to secure their preferred time slots.
•MADE Baseball allows clients to mix and match coaches within the same lesson package to provide flexibility.
Cancellation Policy:
•Clients must cancel or reschedule lessons at least 24 hours in advance through their account in our scheduling system.
•Cancellations made within the 24-hour window will result in the session being forfeited. No exceptions.
•Reminder texts are sent 24 hours before scheduled lessons. Once reminders are sent, cancellations will adhere to this policy.
Refunds:
Refunds are generally non-refundable except in the following circumstances:
•The first lesson in a package is unsatisfactory (refund applies to unused lessons only).
•A coach is unable to fulfill a session, and no alternative rescheduling works for the client.
Refund requests must be made within 7 days of the missed session. Refunds are processed within 5–7 business days.
5. Payments
•Payment Process: Payments are required at the time of booking to confirm sessions.
•Lesson Packages: Clients may purchase lesson packages that expire one year from the date of purchase.
•Gift Certificates: MADE Baseball offers gift certificates valid for three years. Both packages and gift certificates are transferable upon request but non-refundable.
6. Weather Policy
Lessons may be canceled due to severe weather conditions, including but not limited to:
•Lightning, heavy rain, or extreme heat.
•Poor air quality or other environmental concerns.
Coaches will notify clients as soon as possible if a session is canceled due to weather. Missed sessions due to weather can be rescheduled at no additional cost.
7. Non-Solicitation Policy
Clients agree not to solicit MADE Baseball coaches for private lessons outside of the MADE Baseball platform. This includes:
•Contacting coaches directly to bypass the platform for future sessions.
•Attempting to negotiate reduced rates or private arrangements outside MADE Baseball.
Violations of this policy may result in the termination of services and legal action.
SECTION 2: TERMS FOR COACHES
1. Independent Contractor Relationship
Coaches are engaged as independent contractors and are not employees of MADE Baseball.
Key Terms:
•Coaches are responsible for managing their schedules, conducting lessons, and maintaining high standards of professionalism.
•Coaches may not represent MADE Baseball in legal or financial matters without prior written approval.
•Coaches are responsible for their own taxes, insurance, and compliance with local laws.
2. Responsibilities of Coaches
Coaches agree to:
•Deliver lessons consistent with MADE Baseball’s high standards of quality and professionalism.
•Communicate promptly with clients to confirm bookings and handle rescheduling.
•Adhere to all safety guidelines and maintain proper equipment for lessons.
Failure to meet these standards may result in termination of the relationship with MADE Baseball.
3. Payments
Coaches are paid per session and must provide accurate payment information. MADE Baseball reserves the right to withhold payments in cases of:
•Cancelled sessions due to coach negligence.
•Substantiated client complaints about lesson quality or conduct.
Coaches are responsible for all applicable taxes and deductions.
4. Non-Solicitation and Non-Compete Clause
To protect MADE Baseball’s business interests:
•Coaches are prohibited from soliciting or accepting MADE Baseball clients for private lessons outside the platform during their engagement and for two (2) years following termination.
•Coaches may not establish or promote a competing service offering baseball lessons within a 50-mile radius of any MADE Baseball operating area for two (2) years after leaving MADE Baseball.
•Violations may result in legal action, including injunctive relief and financial damages.
5. Confidentiality and Intellectual Property
Coaches must not disclose any proprietary information, including:
•Client contact details or personal data.
•MADE Baseball’s training methods, pricing, or business strategies.
Coaches must return or destroy any confidential materials upon termination.
6. Background Checks and Eligibility
Coaches consent to comprehensive background checks conducted by Checkr during the onboarding process. MADE Baseball reserves the right to terminate a coach’s relationship based on the results of such checks.
7. Arbitration Clause
Disputes between MADE Baseball and its coaches will be resolved through binding arbitration in Savannah, Georgia, or virtually, as agreed upon by both parties.
Privacy Policy
The Privacy Policy applies to both Clients and Coaches. MADE Baseball is committed to safeguarding your personal information.
•Data Collection: We collect personal information (e.g., name, contact details, payment data) to facilitate bookings, payments, and background checks.
•Data Protection: All data is stored securely and shared only when necessary for operations (e.g., payment processing or legal compliance).
•Data Retention: Personal data is retained for up to five (5) years following termination of services or contracts.
